If I want to do premium processing of my H1 visa, how long does it take for an approval or denial ?
Actually I had an H1 visa 2 years back and when I had my baby I quit my job and my H1 was cancelled by my company. Now I am on H4 and want to work again. But no company is doing H1 these days without a job offer in your hands and even if I get a job offer no client company is willing to wait for a long time for my H1 approval. So, I wanted to check my options with premium processing. How long does it take if I go for premium processing of H1 visa ?

A friend of mine has PhD in aeronautics from a top tier university here in US. He will be soon starting teaching in a university and planning to file his GC under EB-1.
Are there any risks in getting I-140 approved under EB-1? or just having a PhD does not automatically qualify anyone under EB-1 category.?
Since he is born in India so reluctant to file under EB-2 due to endless wait.
Depends on whether the role for which he is applying requires a PhD or not. Once again, consult a good lawyer.

Keep on calling SSN office and ask the status. After 1month ask them to expedite the request. It may take morethan 6months also as the systems are not in sync and ssn has to get confirmation from uscis.

Did they ask you to provide I693(Medical) and I684(Affidavit of Support) during your last interview? I believed I had submitted I693 when I applied I485 and I684 is for family-based immigration. Is this right?

Hi,
My friend got his H1 last year for 2007-2008 and came to US in DEC 2007, he works for IT company. However, since he has arrived he has not been placed on a project and so no pay stub has been generated. He has been on bench for 6 months.(technically without a job but has H1)
Is he out of status?
Can he show that he is on vacation till he gets a project?
Is there any other way?
Pls help.

The HR should ask you for the authorization before joining or when you do the HR paperwork. They might be assuming you're a US Citizen.

Guru's please help with the following situation: Labor PD: Dec 2002, Labor approved Feb 2005, I-140 approved May 2005, Filed I-485 (because of retrogation) in May 2006 for both me and wife. Got EAD Dec 2006. Got laid off in Feb 2007 from sponsoring company and decided that I have had enough of US immigration waiting and returned to home country for good in April 2007. Changed address to friends US address for USCIS records just to make sure that any communication from USCIS does not get lost in the mail. Was sure that the employer will cancel the whole GC process. But to my suprise on April 21st 2008, received the automated email from USCIS that 485 has been approved. The I-797 approval notice of action was received at my friends US address with a note that the plastic card should arrive within 30 days. This was back in April-May 2008 time frame. Well the plastic card never arrived inspite of phone calls to USCIS to either cancel the 485 or send the card.
Can someone please educate me as to what I should do get the 485 cancelled and stop further processing of my wife's 485. I am afraid that I am stuck in a situation where the USCIS records indicate that I am a permanent resident when they never fully approved my case in time, while I have been out of the US for 2 years and do not intend to return. The US Consulate here has been of no help. Will this have any overhang for future US visits/immigration for me and my wife or for my children who are US Citizens.

My wife was pregnant when we did the July 2007 485 filing and now is being asked for the TB Test. It says X ray is mandatory on the letter from USCIS. The Immi DOctor said its really not and really depends on the skin test - so he will write and take care of that in the letter.
Next thing is that I am not with the same employer who I was with when I filed 485 in July 2007. Thus dont have an attorney any more. Do I need to send the response with a G28 form with no Attorney representation from now on OR do I just reply with no G28 form to indicate I no longer have Legal representation?
Whats the right way of handling this?
USCIS regs require skin test results. The easiest way to take care of the RFE is to do what they ask for.
As for G-28, you should send a new G-28 with your name as both representative and applicant to the service center where I-485 is pending.
